Welcome to Dave Cook Fitness. These comprehensive Terms and Conditions govern the professional relationship between Dave Cook Fitness and you, the client. By engaging our personal training or online coaching services, you agree to comply with and be bound by these terms. If you disagree with any part of these legal provisions, please refrain from using our services or accessing our online training platforms. These agreements ensure a safe, productive, and respectful environment for all participants.
1. Services and Health Safety
1.1 Service Provision: We offer bespoke online coaching and in-person personal training. 1.2 Health Disclaimer: Physical exercise is strenuous. You must obtain medical clearance from a GP before starting. 1.3 Assumption of Risk: You acknowledge that you participate voluntarily and at your own risk. 1.4 Liability Waiver: Dave Cook Fitness is not liable for injuries or health issues arising from sessions. 1.5 Results: We do not guarantee specific outcomes; results depend on individual commitment.
2. Attendance and Bookings
2.1 Bookings: All sessions are scheduled via our app. 2.2 Cancellation: 24 hours' notice is required to cancel or move a session. 2.3 Lateness: Sessions starting late due to the client will still end at the scheduled time. 2.4 No-Shows: Failure to attend without notice results in full session forfeiture. 2.5 Third-Party Gyms: Clients must adhere to all external gym rules and code of conduct during in-person sessions.
3. Financial Agreements
3.1 Payments: All fees for packages or monthly coaching must be paid in advance via GBP. 3.2 Refunds: Payments are non-refundable. Exceptional cases are at our sole discretion. 3.3 Expiry: Block bookings must be used within six months. 3.4 Price Adjustments: We reserve the right to change prices with 30 days' notice. 3.5 Termination: You may cancel your subscription by providing notice before the next billing cycle.
4. Digital and Legal Data
4.1 Intellectual Property: All programs, documents, and app content remain the property of Dave Cook Fitness. 4.2 Privacy: Data is handled per UK GDPR. 4.3 Minors: Services are for those aged 18+. 4.4 Testimonials: We only use progress photos with your explicit written consent. 4.5 Governing Law: These terms are governed by the laws of England and Wales. 4.6 Contact: For enquiries, please contact us directly through the official website channels.
